These Terms of Service ("Terms") govern your use of tahoepaddle-sports.com (the "Site") and the guided clear-kayak tour services offered by Tahoe Paddle Sports ("we," "us," or "our"). By using the Site or booking a tour, you agree to these Terms.

1. Our Services

We offer guided clear-kayak tours departing from Sand Harbor State Park on Lake Tahoe. Tour bookings, availability, and pricing shown through our online booking calendar are provided and processed by our third-party scheduling partner, FareHarbor, under its own terms. Reservation dates, times, capacity, and pricing are subject to change and are only confirmed once your booking is completed through FareHarbor.

2. No Guarantee of Specific Conditions or Outcomes

Descriptions, photos, and itineraries on this Site are illustrative of a typical tour and are not a guarantee of specific lake, weather, wildlife, or visibility conditions on any given day. Lake Tahoe conditions can change quickly; we (or Nevada State Parks staff) may modify, reschedule, or cancel a tour for safety reasons at our discretion. Any "guaranteed" language used in marketing describes our service standard, not a binding legal guarantee, and does not override the specific terms of your FareHarbor booking confirmation.

3. Communications Consent

By providing your phone number or email address to us, you consent to receive tour-related communications (confirmations, safety/weather updates, and reminders) from Tahoe Paddle Sports by phone, text message, or email. If you separately opt in to promotional messages, standard message and data rates may apply, message frequency varies, and you may opt out of text messages at any time by replying STOP (or HELP for assistance). Consent to promotional communications is never a condition of booking a tour. See our Privacy Policy for full details on how we handle your information, including our TCPA practices.

4. Your Responsibilities

• Provide accurate, complete booking and contact information.
• Meet the age, health, and swimming-ability requirements communicated at booking, and follow all safety instructions given by your guide.
• Arrive on time; late arrivals may forfeit their reservation without refund, per FareHarbor's booking terms.
• Use the Site lawfully and not attempt to disrupt, scrape, or misuse it.

5. Assumption of Risk

Kayaking on open water involves inherent risks, including but not limited to cold water, changing weather, capsizing, and physical exertion. By booking and participating in a tour, you acknowledge these risks and agree to follow all safety guidance provided by our guides. A separate liability waiver may be required before departure.

6. Intellectual Property

All text, photos, graphics, and other content on this Site are owned by or licensed to Tahoe Paddle Sports and may not be copied, reproduced, or reused without our prior written permission.

7. Warranty Disclaimer

The Site and its content are provided "as is" and "as available," without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.

8. Limitation of Liability

To the fullest extent permitted by law, Tahoe Paddle Sports will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or participation in a tour. Our total liability for any claim arising from a booked tour is limited to the amount you paid for that tour, except where a signed waiver or booking agreement provides otherwise.

9. Indemnification

You agree to indemnify and hold harmless Tahoe Paddle Sports, its owners, guides, and staff from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Site, or your participation in a tour, except to the extent caused by our own negligence.

10. Third-Party Links & Tools

The Site links to and embeds third-party tools, including FareHarbor for booking. We are not responsible for the content, availability, or privacy practices of third-party sites or services.

11. Governing Law & Venue

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Washoe County, Nevada.

12. Changes

We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Site after changes take effect means you accept the updated Terms.
